Terms of Service

These Terms of Use (Terms) explain the obligations of National Employment Services Association (NESA) Ltd (operating the Nesa Academy (‘us, ‘we’ ‘NESA LTD’ or ‘Nesa Academy’)) as the provider of training solutions and other services (Our Services) and your obligations as a participant or other user of Our Services.

These Terms are binding on any use of Our Services and apply to you from the time that we commence delivery of, or otherwise provide you with access to, Our Services. Our Services include any training course provided to you by Nesa Academy (Course); all training materials, including online documentation, provided or made available to you; and your use of the website nesaacademy.com.au and its Learning sign-in and registration area (the Site or Platform).

By using or accessing the Site in any way, viewing or browsing the Site, or adding your own content to the Site, you are agreeing to be bound by these Terms of Service.

Intellectual Property

The Site and all of its original content are the sole property of NESA Ltd and are, as such, fully protected by the appropriate international copyright and other intellectual property rights laws.

All copyright, trademark and other proprietary rights associated with Our Services (including all graphics, logos, design elements, audio, music and all other materials originating from or used within the Platform) are reserved to Nesa Ltd and/or its licensors.

You acknowledge that all intellectual property rights in Our Services are licensed (not sold) to you, and that you have no rights in, or to, Our Services, any course or training materials or the Platform other than the right to use them in accordance with these Terms.

Subject to these Terms, we grant to you a non-exclusive, revocable and non-transferrable limited license to view, download and use Our Services in accordance with these Terms.

You agree that any user generated content produced by you through use of Our Services is licensed to us for the purposes of the provision of Our Services and may be used by us to fulfil provision of Our Services to you and also for any ancillary purposes, including provision of services by us to Third Party Referrers.

Terms relating to Payment

If you or your associated business/company are responsible for payment of the applicable fees and charges (Fees) relating to a course or other Service, you must adhere to the following terms relating to payment unless otherwise specified by NESA Ltd in written form.

You must pay the Fees specified.  We only accept payment by credit/debit card.

Fees are non-refundable except as specified in these terms or otherwise required by law.

If any information that you have given to us proves to be incorrect, which has resulted in our not charging you the correct Fees for the Course or other Service that you are enrolled in, we reserve the right to adjust the Fees (upwards or downwards) so that it is the correct Fee for your circumstances.

GST

The Fees and any other amounts are GST exclusive amounts.

A party must pay GST on a Taxable Supply made to it under these terms. It must do so at the same time and in the same manner as it is required to pay the consideration for the Taxable Supply to which the GST relates.

Any capitalised terms used in this section which are not defined in these Terms have the same meaning as those terms in A New Tax System (Goods and Services Tax) Act 1999 (Cth).

Refunds

If you are unhappy with your purchase or purchased the wrong product, please email us at enquiries@nesaacademy.com.au to discuss. Refund requests must be submitted to Nesa Academy within 30 days of purchasing the product and are provided at Nesa Academy discretion based on the individual’s situation. 

To the extent the purchase relates to a Live Course, refunds will be considered on a case-by-case basis.

Termination

The Nesa Academy reserves the right to terminate your access to the Site, without any advance notice.

Our Site may contain a number of links to other websites and online resources that are not owned or controlled by NESA Ltd. NESA Ltd has no control over, and therefore cannot assume responsibility for, the content or general practices of any of these third-party sites and/or services.

Changes to This Agreement

NESA Ltd reserves the right to modify these Terms of Service at any time. We do so by posting and drawing attention to the updated terms on the Site. Your decision to continue to visit and make use of the Site after such changes have been made constitutes your formal acceptance of the new Terms of Service.

Therefore, we ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use or continue to access the Nesa Academy website immediately.

Best of all, your learning is recorded in the Nesa Academy LMS so you can keep track of what training you have completed. This is important if you want pursue accredited training and looking to have competencies you have already obtained recognised.
